LOS ANGELES, CA -- (MARKET WIRE) -- 03/30/07 -- The law firm of Milberg Weiss & Bershad LLP announces the filing of a nationwide class action lawsuit on behalf of purchasers of pet food recalled by Menu Foods Income Fund ("Menu Foods") based in Ontario, Canada.

The class action, Nunez v. Menu Foods, was filed in the United States District Court for the District of New Jersey. The Complaint alleges Menu Foods was negligent in the manufacture and continued widespread sale of its poisonous pet food products. Menu Foods allegedly knew of contamination problems by late February, but did not initiate a nationwide recall until March 16, 2007. New York state health officials identified aminopterin, a banned toxic substance used to kill rats in other countries, as the contaminant on March 23, 2007. The Complaint seeks compensation, including veterinary and other expenses, for all those who purchased pet food products that was or will be recalled by Menu Foods, including those produced between December 3, 2006 and March 6, 2007.

The nationwide recall includes popular brands such as Iams, Nutro, and Eukanuba and private-label brands sold by retailers Wal-Mart, Safeway, Petsmart, and others. Veterinary professionals estimate thousands of pets across the nation will die of kidney failure or become very sick with similar symptoms as a result of consuming the contaminated products.
